Miss Cobra Seats 2009 Model Search Official Rules

1. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A purchase will not improve your chances of winning.

2. ELIGIBILITY: Contest open only to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older as of 6/01/08. Employees of Sponsor (Sube' Sports) and their respective parent, subsidiary, affiliated companies, and agents and such persons' household and immediate family members (defined as parent, spouse, child, sibling, or grandparent) are NOT eligible to enter contest.

3. TIMING: Contest begins at 12:01 a.m. Pacific Time ("PT") on 06/01/08 and closes at 11:59 p.m. PT on 09/30/08. Four finalists will be chosen from each of four separate judging periods with the following dates: 06/01-30, 07/01-31, 08/01-31, and 09/01-30. Four entrants will advance from each judging period. (In addition, the four entrants with lowest vote total will be eliminated from the contest.) The resultant 16 semi-finalists will then compete, along with the reigning Miss Cobra Seats and her first Alternate, for the title of Miss Cobra Seats 2009 during the final voting and judging period beginning 10/01/08 and ending 10/31/08.

4. HOW TO ENTER: Go to www.subesports.com and click on the Miss Cobra Seats 2007 link, then click on the entry link, and then fully complete the entry form and submit as directed. After you have entered and your entry has been pre-qualified, your submitted information will then be hosted on the contestant page, and you may start to receive votes as directed along with all of the other featured models. Please note that tabulated votes will influence judging, but will not determine the finalists or the ultimate winner (A panel of judges will select all finalists and the ultimate winner). You do not have to vote to enter the contest. Limit one entry per person. One entry will last the duration of the contest. During the entry process, Sube Sports (sponsor) may also ask optional questions on entry form; completion of these optional questions is not required to vote or be entered in the contest.

5. AWARD: Only one (1) Miss Cobra Seat 2009 will be selected from the sixteen (16) finalists during the final voting and judging period, 10/01/08 - 10/31/08. The title (award) is nontransferable and must be accepted upon notification of winning. No cash or other substitution may be made, except at Sube Sports (sponsor) discretion. In the event that the award cannot be presented for any reason, Sube Sports may substitute an award of equal or greater value. Subject to the conditions herein, the award will be granted to the winner and all federal, state, local, and provincial taxes, fees, and surcharges for the award is the sole responsibility of the winner.

6. NOTIFICATION: Potential winners will be notified by mail within eleven (11) days of contest completion, and must return, within ten (10) days of postmark (the "Reply Deadline"), a correctly completed, executed, and delivered (as directed) Affidavit, Waiver, Release, and Indemnity Agreement, and where lawful, a Publicity Release (additional documents may be required at discretion of Sponsor). Failure to comply with the above-mentioned Reply Deadline may result in disqualification and in the forfeiture of any right to the award, in which case the award will be presented to an alternate.

7. IMPROPER CONDUCT: If for any reason this contest is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, human error or any other cause beyond the control of Sube Sports that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the contest, Sube Sports reserves the right in their sole discretion to: a) disqualify any individual who tampers with the entry process; b) require the return of any award or its value; and c) to cancel, terminate, modify or suspend the contest, in which case, winners will be determined from the entries received prior to cancellation, termination, modification or suspension.

8. E-MAIL ADDRESS: Computer entries will only be officially accepted if submitted by the authorized account holder of the submitted e-mail address at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be required to provide proof that he/she is the authorized account holder of the e-mail address associated with the winning entry.

9. RELEASE: BY PARTICIPATING IN THIS CONTEST AND/OR ACCEPTING AN AWARD, A PARTICIPANT/WINNER AGREES THAT THE SPONSOR, THEIR RESPECTIVE SUBSIDIARIES, AFFILIATES, ADVERTISING AND PROMOTION AGENCIES, AND ALL OF THE SPONSOR'S OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE HELD HARMLESS BY PARTICIPANT/WINNER FOR ANY LIABILITY FOR ANY INJURY, LOSS OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING DEATH, AND PROPERTY, DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE AWARD OR PARTICIPATION IN THIS CONTEST OR PARTICIPATION IN ANY CONTEST OR PRIZE RELATED ACTIVITY. By participating in this contest and/or accepting an award, a participant/winner consents to and gives the Sponsor the right in perpetuity to use winner's/participant's name, picture/portrait, likeness, voice, statements, submitted descriptive information (in whole or in part, as may be adapted, edited, or modified, as solely determined by Sponsor) for advertising, trade, publicity and promotional purposes in any media now known or hereafter discovered, worldwide, and on the World Wide Web, without review, notification or approval, all without additional consideration, unless prohibited by law. Sponsor shall have the right to use, assign, edit, modify or dispose of the entry however they see fit without the approval of participant/winner.

10. COMPUTER: Participants agree that by submitting their entries they release the Sponsor and their respective agents from any liability in connection with any error, omission, interruption, deletion, defect, delay, misdirection, or technical malfunctions or traffic congestion on the Internet/telephone network, or at any website, or any combination thereof, including any injury or damage to participant's or any other person's computer/software related or resulting from participation or downloading any material in this sweepstakes. Sponsor and participating promotional companies are not in any way liable for damage, loss or injury resulting from computer malfunctions.

11. ERRORS: Sponsor is not responsible for lost, late, illegible, damaged, incomplete, stolen, or misdirected entries, typographical or other human or technical errors in the offer or administration of this contest, including but not limited to errors in advertising, the Official Rules, the selection and announcement of the winners or the distribution of the award. Sponsor reserves the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the contest. In the event the contest is challenged by any legal or regulatory authority, Sponsor reserves the right to discontinue or modify the contest, or to disqualify participants residing in the affected geographic areas. In such event, Sponsor shall have no liability to any entrants who are disqualified due to such an action.

12. LAWS: Subject to all federal, state, provincial, and local laws and regulations. Void where prohibited.

13. WINNER LIST: A winners' list is available by sending an SASE to: Sube Sports, Miss Cobra Seats 2007 Winner's List, 17161 Palmdale Street, Huntington Beach, CA 92647. A list of winners from each monthly voting and judging results will be available about 4 weeks after each closing date; the complete winners' list (with all winners) will be available from about 10/31/08 to 1/15/09.
